Terms & Conditions

Fast Web Guru believes that transparency, integrity and fairness for both sides are the core values in this business. We have written this contract to protect both parties against future issues and conflicts. This imposes clear understanding towards each other and suggests a great working relationship.
1. Payment Terms

1.1   The Client will pay the Developer a certain amount on a monthly basis on an Autopayment system through Credit/Debit Card via Paypal or Bank Deposit/Transfer

1.2   Invoicing System

1.1.1   Client’s due date differs accordingly.
1.1.2   Invoice will be sent 14 days before due date.

1.3   It is agreed that the Project will be placed and is delegated to the Developer’s team for processing immediately after the first payment is made.

2. LOCK-IN POLICY

2.1   There is a six (6) month lock in policy before the Client can cancel his/her subscription to the Developer’s product/service

3. SUSPENSION & TERMINATION

3.1   If the Developer does not receive payment within the agreed payment period, a grace period maximum of fifteen (15) days before the Developer remove all web contents from the internet

3.2   If the Client terminates the contract, the Developer reserves the right to keep/delete all intellectual property which refers to domain name, google suite account, work files, programming and system coding, and any contents.

3.2.1   If the Client wants to obtain these, he/she can buy it from the Developer subject for a quotation

4. MODIFICATIONS

4.1   The Client will then take full responsibility of his/her website and accounts after the website has been approved and made live

4.2   The Developer will provide the Client a complete set of knowledge based articles, resources and tutorials

4.3   The Developer is not liable for loss, damage or corruption to files or information upon this stage caused by the Client’s actions but the Developer can be asked to restore a backup if it’s possible

4.4   The Developer understands, however, that Clients may request significant design changes to pages that have already been built to the Client’s specification. To that end, please note that our agreement does not include a provision for “significant page modification”. If significant page modification is requested after a page has been built to the Client’s specification, we must apply an additional charge and will be based on a customized quote

5. PRIVACY & CONFIDENTIALITY POLICY

5.1   The Developer, its employees and subcontractors agree that, except as directed by the Client, it will not at any time during or after the term of this Agreement disclose any Confidential Information to any person whatsoever. Likewise, the Client agrees that it will not convey any confidential information obtained about the Developer to another party or pass on any forms including these to any third party.

5.2   Client also agrees to defend, indemnify and hold harmless the Developer against Liabilities arising out of any injury to person or property caused by any products or services sold or otherwise distributed over the Client’s website. This includes infringing on the proprietary rights of a third party, copyright infringement, and delivering any defective product or misinformation, which is detrimental to another person, organisation, or business.

6. MAINTENANCE

6.1    The Project website, hosting, domain, email address, email marketing software, plugins, help ticket system, etc will be hosted by a mixture of third party providers engaged by the developer. All service level agreement will mirror (not exceed) those offered by these third party companies. The Developer will communicate such terms to the Client upon request.

6.2    The Developer will not be liable for general issues, errors and downtimes caused by the third party providers as these companies may schedule regular maintenance of servers on their end which is necessary for smooth running of the website and software's. The developer will forward announcement and notices related to maintenance if necessary.

7. DELIVERY & TURN-OVER

7.1    The Developer will give the Client all the login access details to all the involved accounts

7.2    The Developer shall expect the Client to carry out sufficient research through the provided knowledge base resources and tutorials before touching anything on the website

7.3    The Developer agrees to provide support and guidance to the Client to the best they can if requested
